Premier Tributes LLC — Client Booking Terms

Premier Tributes LLC is a talent agency licensed by the State of California, License No. TA-LR-1001316885. We act as the performer's agent in arranging engagements.

The engagement agreement is between you and the performer. We arrange it, document it, and administer it as agent. The performer supplies the performance; we do not. The signed engagement agreement sets out the commercial terms of your booking and controls where it differs from anything on this page.

Our commission is paid from the performer's fee in accordance with our fee schedule filed with the Labor Commissioner. You do not pay us a separate commission or booking fee unless expressly stated in your engagement agreement.

Inquiry. You tell us the date, location, budget range, and what you are looking for.

Proposal. We present available acts with rates and terms. Rates depend on date, location, travel, production requirements, and performance length.

Quote. The performer confirms their fee and conditions. We send them to you.

Agreement. When you accept, we issue a written engagement agreement setting out the act, date, times, location, fee, deposit, technical requirements, and cancellation terms.

Confirmation. The booking is confirmed only when the agreement is signed and the deposit is received. Until then nothing is held and the date remains available.

Deposit. A deposit is due on signing. The amount, and whether it is refundable, are stated in your agreement.

Balance. Due as stated in your agreement.

Method. As stated in your agreement.

Additional costs. Travel, lodging, ground transport, backline, sound and lighting, and union or pension contributions where applicable are stated in your agreement. If they are not stated, they are not included.

Late payment. Amounts unpaid when due may accrue interest at the rate stated in your agreement, up to the legal maximum.

Your agreement and the act's technical rider specify what the performer supplies — instruments, backline, sound, lighting, personnel count, set lengths, and break structure — and what you or the venue must supply.

Read the rider before signing. Most day-of problems come from a rider requirement nobody arranged. If anything in it is impractical at your venue, tell us before signing and we will work it out.

By you. Cancellation terms, including any deposit treatment and any point after which the full fee becomes payable, are stated in your agreement and typically scale with proximity to the date.

By the performer. If the performer cancels for any reason other than a cause listed below, we will use best efforts to supply a comparable replacement act at no additional cost, or refund all amounts paid, at your election.

Force majeure. Neither party is liable for failure to perform due to causes beyond reasonable control — including severe weather, natural disaster, death or serious illness, government order, public health closure, venue closure, or transport failure. In that case the parties will attempt to reschedule; if rescheduling is not possible, deposits are handled as stated in your agreement.

You will provide: safe and lawful performance conditions; the stage, power, and access described in the rider; parking and load-in as agreed; meals and hospitality where specified; and any permits or licenses required for the event or venue.

Music licensing. Public performance of copyrighted music generally requires a license from a performing rights organization. That license is customarily held by the venue or the event host, not by the performer or by us. Confirm the venue is licensed.

No audio or video recording, broadcast, streaming, or commercial use of the performance without the performer's prior written consent. Casual attendee photography is normally fine; anything intended for publication or commercial use is not, absent consent.

Many acts we represent are tribute or cover acts. They are not associated with, endorsed by, or sponsored by the original artists whose material they perform. They perform in the style of, and as a tribute to, those artists. Marketing for your event should describe the act accurately and should not suggest the original artist is appearing.

If you promote the event, use the act's own name and materials. We can supply approved promotional assets.

We are responsible for: arranging the engagement, documenting it accurately, communicating terms between you and the performer, and administering payments as agent.

We are not responsible for: the artistic content or quality of the performance; the performer's conduct; the performer's compliance with venue rules; the accuracy of performer-supplied profile information; venue conditions; or any matter outside our role as agent.

Performers are independent contractors, not our employees.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREMIER TRIBUTES LLC'S TOTAL LIABILITY ARISING FROM ANY ENGAGEMENT WILL NOT EXCEED THE COMMISSION WE RECEIVED ON THAT ENGAGEMENT.

WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR EVENT COSTS.

Nothing limits liability that cannot be limited under California law.

We recommend that clients carry event liability insurance. Performers may be required to carry their own general liability coverage, as stated in your agreement.

Performers: controversies arising under the California Talent Agencies Act between an artist and a licensed talent agency are within the original jurisdiction of the Labor Commissioner.
